These Terms of Service ("Terms") govern your use of Shooting Birds Carnival (the "Game"), a mobile game published by Tech Artists ("we," "us," or "our"), and the shootingbirds.app website. By downloading or playing the Game, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or playing the Game, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Game.
2. Eligibility
The Game is suitable for all ages. If you are a minor, you should review these Terms with a parent or guardian. The Game collects no personal information and requires no account. It does contain one optional in-app purchase, so a parent or guardian should be aware of it — see section 5. Purchases are handled by Apple, and Apple's own parental controls (Screen Time → Content & Privacy Restrictions) can require approval for, or block, in-app purchases entirely.
3. Your License to Use the Game
We grant you a personal, non-exclusive, non-transferable, revocable license to download and play the Game for your own non-commercial entertainment on devices you own or control, as permitted by the App Store Terms of Service.
You may not:
- Sell, rent, sublicense, or redistribute the Game or any part of it;
- Reverse engineer, decompile, or disassemble the Game, except where that right cannot be excluded by law;
- Extract, reuse, or redistribute the Game's artwork, characters, audio, or other assets;
- Modify the Game or create derivative works from it;
- Use cheats, automation, or modified clients in a way that interferes with the Game's operation;
- Remove or obscure any copyright, trademark, or other proprietary notices.
4. Accounts
The Game has no accounts, no login, and no online services of our own; the only network activity is Apple's own App Store handling of the in-app purchase. Your progress is stored locally on your device, as described in the Privacy Policy. We do not back it up, and we cannot restore it if it is lost — for example if you delete the app, reset progress from the main menu, or replace your device without a device-level backup.
5. Price, Ads & Purchases
The Game is free to download. The first three booths are free to play without limit. As of this version it contains:
- No advertising of any kind;
- One optional in-app purchase — a single, one-time, non-consumable unlock for the remaining eight booths. It is not a subscription, and there is no currency or anything else offered for sale;
- No time limits on the free booths — they do not expire, and your scores, tickets and prizes are kept whether or not you buy;
- Family Sharing enabled on that purchase, so one unlock covers your Apple Family Sharing group.
The unlock is tied to the Apple ID that bought it. If you reinstall the Game or move to another device, use RESTORE in the game's unlock screen to recover it at no additional charge, as required by the App Store. Nine weapons and all twenty-six prizes are earned by playing, with tickets the Game gives you — they are not for sale.
Tickets and prizes in the Game are entertainment features with no monetary value. They cannot be bought, sold, redeemed, or exchanged for anything of value, inside or outside the Game.
Payment and refunds are handled entirely by Apple. The price shown on the App Store governs, and it may vary by country and change over time. We never receive or hold your payment details. Refund requests go to Apple through reportaproblem.apple.com, under Apple's policies rather than ours.
If a future version changes what is offered for sale, or introduces advertising, that will be disclosed in the App Store listing and release notes for that version, and this page and the Privacy Policy will be updated before it ships.
6. Acceptable Use
The Game is single-player and offline, so there is little scope for misuse, but you agree not to use it to violate any law, to interfere with its normal operation, or to attempt to gain unauthorized access to any system.
7. Intellectual Property
The Game and everything in it — including its artwork, bird characters, booth designs, name, logo, and code — is owned by Tech Artists and protected by copyright, trademark, and other laws. These Terms grant you a license to play, not any ownership.
The bird character library is shared across our games (Bird Blitz, Dropping Birds, Swooping Birds and Shooting Birds Carnival) and remains our property in each.
8. Updates & Availability
We may update, change, or discontinue the Game or any of its features at any time without notice. We may also stop distributing it. We are not obliged to maintain support for any particular device or iOS version, and newer versions may drop support for older hardware.
9. Third-Party Services
The Game is distributed through Apple's App Store and TestFlight, and your use of those services is governed by Apple's terms. Apple is not responsible for the Game, and these Terms are between you and Tech Artists, not Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Disclaimers
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components, or that your saved progress will be preserved.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECH ARTISTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROGRESS, ARISING OUT OF YOUR USE OF THE GAME. Our total aggregate liability to you shall not exceed the greater of the amount you actually paid for the Game and its in-app purchase or ten US dollars (US$10.00).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.
12. Indemnification
You agree to indemnify and hold harmless Tech Artists from any claim arising out of your misuse of the Game or your violation of these Terms or of any law or third-party right.
13. Termination
These Terms apply for as long as you use the Game. You may end them at any time by deleting the Game. We may terminate or suspend your license if you materially breach these Terms. Sections covering intellectual property, disclaimers, liability, and indemnification survive termination.
14. Governing Law & Disputes
These Terms are governed by the laws of the United States and the State of Tennessee, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in Tennessee, and you consent to the personal jurisdiction of those courts. Nothing here deprives you of the protection of mandatory consumer-protection laws of your country of residence.
15. Changes to These Terms
We may revise these Terms from time to time. The "last updated" date above will change, and continued use of the Game after an update constitutes acceptance. Material changes will also be noted in the release notes for the version that introduces them.
